SAFECHECK — TERMS OF USE (BETA / TRIAL VERSION) Last updated: June 2026 Please read these Terms of Use before using SafeCheck. By ticking the checkbox on the access screen and continuing to use the app, you agree to the terms below. 1. TRIAL PRODUCT SafeCheck is currently provided as a trial / beta product for a limited trial period. Features, the hazard and control task database, pricing, and access arrangements (including access keys) may change or be withdrawn at any time without notice as the product is developed. 2. DECISION-SUPPORT TOOL ONLY SafeCheck is a decision-support tool intended to help identify common hazards and controls for selected work tasks. It is NOT a substitute for a site-specific risk assessment carried out by a competent person, and does NOT replace your obligations as a PCBU under the Health and Safety at Work Act 2015 (and any amendments) and its regulations. You remain solely responsible for health and safety compliance on your sites, including identifying hazards not listed in the app. 3. NO WARRANTY Hazard, risk, and control information in SafeCheck is provided "as is" and "as available", without warranty of any kind, express or implied, including as to accuracy, completeness, currency, or fitness for a particular purpose. SafeCheck does not guarantee that all hazards relevant to any task, site, or piece of work have been identified. 4. YOUR DATA All assessment records, incident records, settings, and your access key are stored locally on your own device only. SafeCheck does not access, transmit, collect, or store this data on any server. SafeCheck is not responsible for loss of data resulting from clearing browser data, changing devices or browsers, device failure, or similar events. You are responsible for exporting (e.g. via email or copy) and retaining copies of any records you need to keep. 5. FEEDBACK SafeCheck is in active development, and your feedback helps shape future versions. By using SafeCheck during the trial period, you agree that: (a) any feedback, suggestions, bug reports, corrections, or comments you provide to SafeCheck ("Feedback") are given voluntarily and free of charge, without any expectation of payment, compensation, credit, equity, or any other consideration; (b) SafeCheck may use, copy, modify, adapt, and incorporate the Feedback in any way it sees fit, including in future versions, updates, or releases of SafeCheck or related products, without any obligation, payment, or attribution to you; and (c) you will not assert any claim against SafeCheck arising from its use of Feedback you have provided. 6. LIMITATION OF LIABILITY To the maximum extent permitted by law, SafeCheck, its creators, and anyone associated with its development accept no liability for any loss, damage, injury, cost, or claim of any kind arising from or connected with your use of (or inability to use) the app, including any reliance on hazard, risk, or control information shown in it. 7. CHANGES TO THESE TERMS These Terms, and the app itself, may be updated at any time as SafeCheck is developed. Continued use of SafeCheck after an update constitutes acceptance of the updated Terms. 8.
